Tell him you're going to cancel the transaction and offer it to the second highest bidder under the "second chance" rules. Then report him to eBay as a non-paying bidder.
The only thing he's investigating is whether he was too stupid to stop bidding. That doesn't give him the right to hold you hostage. Good luck!
